Solo Marcuse ha tratado de decir lo indecible en un esfuerzo cada vez más urgente por reintroducir un molde utópico a la teoría socialista.

En este texto nos proponemos abordar la última clase del semanario de Deleuze sobre el poder en Foucault a partir de dos momentos. El primero tiene que ver con el concepto de imagen y la interpretación sobre el cine que ya venía siendo una constante —aunque marginalmente— en estas clases de Deleuze. Seguidamente, el segundo momento tiene que ver con la relación entre poder y resistencia que arroja como resultado una interpretación del pensamiento de Foucault por parte de Deleuze como (...) una obra viva y en constante construcción. Así, cumpliremos con la exigencia de una lectura que invita a pensar en los conceptos como herramientas de análisis integradas al desarrollo de situaciones donde el poder se presenta como noción central. En este trabajo nos enfocamos fundamentalmente en responder dos interrogantes: (a) ¿Pueden las mujeres ser sujetos ilustrados desde la perspectiva de Hume? y en caso de responder afirmativamente, (b) ¿resulta esta ilustración emancipatoria en términos feministas? En primer lugar, reconstruimos las principales líneas de interpretación feministas de la obra de Hume para ubicar nuestra propuesta dentro de una corriente interpretativa poco explorada aún. En segundo lugar, precisamos el sentido que puede adoptar la noción de “ilustración” en la filosofía de Hume, (...) en discusión con debates de la literatura secundaria contemporánea. En tercer lugar, orientamos nuestra reflexión a responder el primero de los interrogantes e indagamos si las mujeres están incluidas dentro de los rasgos ilustrados que podemos reconocer en el pensamiento de Hume y en qué condiciones. En cuarto y último lugar, ensayamos una respuesta al segundo interrogante: si aquello que podemos interpretar como ilustración femenina en clave humeana constituye una vía para la emancipación de la dominación patriarcal o si, por el contrario, refuerza el sometimiento de las mujeres. Basándome en la explicación que hace Jean-Paul Sartre de la violencia, sostengo que no solo la mala fe es inevitable en la práctica, sino que una mala fe limitada es necesaria para la autenticidad. Aunque violar la libertad de otros es mala fe, es imposible no violar nunca la libertad de alguien. Además, y de manera fundamental, la estructura ontológica del para-sí implica que este solo puede ser auténtico en el modo de no ser auténtico. Tratar de evitar por completo (...) la mala fe es, en sí mismo, un acto de mala fe, porque es un intento de constituirse como esencialmente auténtico, pero el para-sí no tiene esencia preexistente. Sin embargo, al reconocer la total responsabilidad de uno por elegir la mala fe, se limita su alcance. Esta mala fe limitada es, de hecho, necesaria para la autenticidad, un proyecto vivido en situaciones concretas y no una ley moral categórica que prohíbe la mala fe. The enigma of consciousness, particularly the subjective and ineffable nature of qualia (our inner conscious experience), poses one of the most challenging puzzles in contemporary philosophy and cognitive science—the "hard problem". Grounded in interdisciplinary perspectives from philosophy of mind and neuroscience, this article introduces a novel theoretical framework aimed at elucidating the mysterious nature of qualia and providing a comprehensive explanation for the hard problem of consciousness. Emphasizing the intricate relationship between consciousness, identity, and subjective experience, and analyzing the brain's (...) “atomic nature”, the proposed model challenges reductionist perspectives that solely attribute consciousness to brain function. Here, the role of identity is integrated, emphasizing its centrality in comprehending conscious phenomena. Rejecting simplistic views equating brain states with mental states, the proposed framework also questions exclusive reliance on information integration theories. The suggested model contends that subjective experience transcends corresponding brain activity, introducing a dualistic perspective that involves non-physical information. The uniqueness of human consciousness is underscored, contrasting it with artificial intelligence, and highlighting it as vital for sustaining emotions, genuine comprehension, and engaging in complex behaviors. The paper advocates for a holistic perspective that recognizes the non-material dimension of consciousness, emphasizing its pivotal role in shaping human experience and behavior. This integrative approach seeks to contribute to both theoretical discourse and empirical investigations, fostering a deeper understanding of the nature of qualia and consciousness. (shrink)

And, going further, I say that belief is a feeling or sensation aroused by two factors: habit and the association of ideas, but it does not arise either from one or from other singly, each one is a part of a process that (...) involves both. Therefore habit is an underlying principle which acts upon reasonable beings during their observation of constant conjunctions, in such a way that imagination can associate ideas only through this principle acting in the mind. "El ser es uno con la comida; ser significa comer; es (ist) lo que come (isst) y lo que ha comido. Comer es la forma subjetiva, activa, siendo lo comido la forma objetiva, pasiva, pero ambas son inseparables. Por tanto, únicamente comiendo se llena el concepto vacío del ser y se revela el carácter absurdo de la pregunta: ¿el ser y el no ser son idénticos, es decir, comer y pasar hambre son idénticos?".

El debate entre realistas y antirrealistas científicos puede ser concebido como un caso de desacuerdo profundo entre partidarios de perspectivas epistémicas rivales. Versa sobre los compromisos metafísicos, epistémicos y semánticos a los que deberíamos suscribir sobre la base de nuestras mejores teorías científicas, especialmente respecto de las entidades inobservables postuladas por ellas. Defendemos que, pese a sus discrepancias, tanto realistas como antirrealistas comparten un núcleo mínimo de supuestos compartidos que dotan de sentido a su discusión, y cuyo rechazo implica la (...) impugnación de los problemas filosóficos que caracterizan el debate. Durante este trabajo, presentamos y analizamos estos supuestos comunes, a saber, que la ciencia empírica parece hablar de entidades inobservables (A) postuladas por descripciones aceptables según su adecuación con el modo en el que somos afectados por el mundo (B) en pos de explicar sus aspectos intrigantes del modo más parsimonioso posible (C). Además, argumentamos que constituyen condiciones necesarias para participar de la discusión, y suficientes para generar interpretaciones divergentes por parte de los agentes que discurren. Finalmente, sugerimos que reconocer estos compromisos nos permite comprender mejor por qué es improbable que este desacuerdo sea resuelto por vías argumentativas, aunque sí cabe esperar que sea fructífero en la generación de conocimiento compartido en torno a la práctica científica. No Tratado da natureza humana, David Hume dedica uma longa seção à problemática sobre a possibilidade da existência do mundo externo intitulada “Do ceticismo quanto aos sentidos”. A seção traz idas e vindas do autor no que diz respeito à resposta para o problema. Inicialmente, Hume dá como certa a existência externa dos corpos, i.e., independente das percepções, e avisa que sua investigação se limitará, apenas, às causas que levam a crer nisso. Sua pretensão inicial não é cumprida e logo (...) dá espaço a uma rede de complexos argumentos céticos, os quais colocam em dúvida as realidades independentes das percepções. No último parágrafo, porém, Hume parece retroceder em sua posição e parece tomar como certa a existência independente dos corpos, mais uma vez, tal como fez no começo da seção. O objetivo desse trabalho foi, pois, evidenciar que há dois pontos bem diferentes que caracterizam sua argumentação sobre esse assunto: I) A existência do mundo externo; II) a possibilidade de conhecê-lo. Ao primeiro, a resposta de Hume será positiva, ao segundo ponto, negativa. O ceticismo, portanto, sempre decorreria de qualquer tentativa em conhecer tais realidades independentes, pois, através da argumentação filosófica, da razão, sempre se esbarraria na impossibilidade de sua existência. Ao mesmo tempo, sua realidade ontológica parece se impor pela própria natureza e, com isso, desativa os argumentos céticos, os quais sempre demonstram a impossibilidade de conhecê-lo, i.e., acessá-lo pela razão. Assim, o que se tem sobre o mundo externo são, apenas, impressões geradas através da experiência para com o mesmo. Em vista dos fins supracitados, foram utilizados, além do Tratado, a Investigação sobre o entendimento humano e outros textos do filósofo escocês. (shrink)

Este texto se propone indagar la formulación de la dimensión estética en Marcuse. Para ello se abordará algunas consideraciones del autor sobre el arte y las posibilidades revolucionarias que éste comporta. Para Marcuse, el arte puede llegar a ser un elemento subversivo que configuraría una sensibilidad diferente a la que produce una sociedad regida por un principio de realidad que estanca la realización del placer en función de una vida agobiada y malograda entre los hombres. Las posibilidades de una nueva (...) configuración de las relaciones sociales, que estén de acuerdo con la pacificación de la existencia y el libre desarrollo de las capacidades humanas, tienen su condición de posibilidad en la forma estética que muestra, y hasta ahora inmediatamente esconde, el horizonte de un principio de realidad que establezca las bases sobre las cuales la vida humana sería digna de ser vivida. Sociedad industrial avanzada es un concepto que utiliza Herbert Marcuse para referirse a las sociedades capitalistas de posguerra del siglo XX, más exactamente sociedades bajo el modelo norteamericano. Estas sociedades se erigen desde una base de producción capitalista que más allá de estar específicamente al servicio del interés particular de una clase –algo que no se puede negar– también logra satisfacer la inmediatez de gran parte de los miembros que la conforman. Así, cualquier persona que viva bajo el régimen de (...) producción capitalista puede tener acceso a los productos que hagan de su vida una vida más llevadera. Que la vida se haga más cómoda en condiciones capitalistas es algo que salta a la vista, pues el desarrollo de la técnica genera en ella múltiples avances que hoy hacen que plantearse la eliminación global de todo agobio material, por ejemplo, sea una posibilidad real y concreta. En este texto se trata la relación entre el principio de subjetividad y el principio de soberanía que emerge de la obra Filosofía del derecho de G. W. F. Hegel. Esta correspondencia se establece dentro del marco de la Eticidad [Die Sittlichkeit], que se expone en la tercera parte de la Filosofía del Derecho. Para el autor mencionado, la libertad del individuo, como rasgo característico del Estado moderno, supone una dialéctica entre derechos y deberes que es la base fundamental en (...) la que se presenta la relación entre subjetividad y soberanía. De esta manera, a partir del cumplimiento de los deberes y la exigencia de derechos, los individuos de la sociedad moderna alcanzan su libertad sin dejar de lado la de los demás, entendiendo que el deber es derecho y el derecho es deber. In their simplest form, consensus gentium arguments for theism argue that theism is true on the basis that everyone believes that theism is true. While such arguments may have been popular in history, they have all but fallen from grace in the philosophy of religion. In this short paper, we reconsider the neglected topic of consensus gentium arguments, paying particular attention to the value of such arguments when deployed in the defence of theistic belief. We argue that while consensus gentium (...) arguments are unlikely to offer anything close to overwhelming support for theism, their probative value is nevertheless underappreciated, and that they have been unfairly maligned as a consequence. Este texto considera la crítica de Ludwig Feuerbach a la filosofía del derecho de Friedrich Julius Stahl a partir de la noción de personalismo; estableciendo la diferencia entre el personalismo cristiano y el perfeccionismo social. Para Feuerbach la doctrina de Stahl se apoya en una versión teórica positiva que no expone filosóficamente los conceptos políticos sobre los cuales pretende fundamentarse. Los postulados sobre la persona humana y la persona divina se presentan aquí como uno de los momentos más contradictorios del (...) proyecto de Stahl, y es allí donde Feuerbach enfoca sus comentarios más agudos. There is something puzzling about statistical evidence. One place this manifests is in the law, where courts are reluctant to base affirmative verdicts on evidence that is purely statistical, in spite of the fact that it is perfectly capable of meeting the standards of proof enshrined in legal doctrine. After surveying some proposed explanations for this, I shall outline a new approach – one that makes use of a notion of normalcy that is distinct from the idea of statistical frequency. (...) The puzzle is not, however, merely a legal one. Our unwillingness to base beliefs on statistical evidence is by no means limited to the courtroom, and is at odds with almost every general principle that epistemologists have proposed as to how we ought to manage our beliefs. En abril de 1961, Jean-Paul Sartre, Simone de Beauvoir y Frantz Fanon se reunieron en un café de Roma. La reunión, por lo menos tal como la registró Beauvoir, duró horas, hasta las dos de la mañana, hasta el momento en que el cuerpo de Sartre, de 56 años, sufrió fatiga. Sartre necesitaba descansar, instó Beauvoir. Fanon, con su cuerpo de 36 años muriendo de leucemia, se resintió de su insistencia: “No me gustan los hombres que acumulan sus recursos”. Él (...) quería aprovechar esa oportunidad de oro de hablar con Sartre durante semanas sin descanso si era necesario. Sin embargo, el agotamiento prevaleció, aunque la reunión legendaria consistió en una conversación sin parar durante casi tres días. Sartre, impresionado por el joven revolucionario, había acordado escribir el prefacio de Los condenados de la tierra, una obra que se supone compuesta durante diez semanas agotadoras, y él y el colectivo editorial también acordaron publicar el primer capítulo en la edición de junio de Les Temps Modernes. La salud de Fanon empeoró a medida que pasaba el año. Eventualmente fue a Bethesda, Maryland, para tratamiento a finales de noviembre, donde fue detenido por la CIA y se le negó el tratamiento. According to a captivating picture, epistemic justification is essentially a matter of epistemic or evidential likelihood. While certain problems for this view are well known, it is motivated by a very natural thought—if justification can fall short of epistemic certainty, then what else could it possibly be? In this paper I shall develop an alternative way of thinking about epistemic justification. On this conception, the difference between justification and likelihood turns out to be akin to the more widely recognised difference (...) between ceteris paribus laws and brute statistical generalisations. I go on to discuss, in light of this suggestion, issues such as classical and lottery-driven scepticism as well as the lottery and preface paradoxes. (shrink)

Recent years have seen an explosion of interest in metaphysical explanation, and philosophers have fixed on the notion of ground as the conceptual tool with which such explanation should be investigated. I will argue that this focus on ground is myopic and that some metaphysical explanations that involve the essences of things cannot be understood in terms of ground. Such ‘essentialist’ explanation is of interest, not only for its ubiquity in philosophy, but for its being in a sense an ultimate (...) form of explanation. I give an account of the sense in which such explanation is ultimate and support it by defending what I call the inessentiality of essence. I close by suggesting that this principle is the key to understanding why essentialist explanations can seem so satisfying. (shrink)

This book explores a question central to philosophy--namely, what does it take for a belief to be justified or rational? According to a widespread view, whether one has justification for believing a proposition is determined by how probable that proposition is, given one's evidence. In this book this view is rejected and replaced with another: in order for one to have justification for believing a proposition, one's evidence must normically support it--roughly, one's evidence must make the falsity of that proposition (...) abnormal in the sense of calling for special, independent explanation. This conception of justification bears upon a range of topics in epistemology and beyond. Ultimately, this way of looking at justification guides us to a new, unfamiliar picture of how we should respond to our evidence and manage our own fallibility. This picture is developed here. Aunque no puede hablarse en sentido estricto de una teoría moral del existencialismo a la manera de los grandes sistemas y modelos éticos de occidente, sí existen muchos argumentos que respaldan una versión en la cual es discutida la moral tradicional en contraposición a la posibilidad de una moral de la situación apoyada por las tesis más importantes de los existencialistas. Simone de Beauvoir ha elaborado un conjunto de textos donde esta posibilidad es expuesta.

Esta reflexión plantea el problema que se da al querer dar cuenta del individuo, como existencia, de manera sistemática en el terreno de las tendencias lógicas de la ética. Sören Kierkegaard, será la guía para plantear que tal pretensión es dañina y se presenta como la imposibilidad para la afirmación de la subjetividad como vitalidad abierta siempre a las posibilidades que ofrece la condición humana. Para el desarrollo de este planteamiento trataremos de confrontar algunos planteamientos de Kierkegaard -sobre todo el (...) de la irreductibilidad de la existencia a sistema- con la eticidad hegeliana en particular, para mostrar cómo se revienta el postulado de un sistema de la existencia. Este reventarse se debe entender no como destrucción de lo dado sino como enfrentamiento de ello y conducción hasta sus últimas consecuencias donde se hace manifiesta la imposibilidad de encerrar la existencia en la estrecha posición de la ética como ciencia normativa, es decir como imperativo de comportamiento y direccionamiento moral de la subjetividad por los carriles del pensamiento que absorbe al ser y que postula a la razón como la directriz de todo proyecto vital. El presente texto intenta establecer algunas bases de la filosofía social de Søren Kierkegaard. Para ello, toma el concepto de lo demoníaco, que se desarrolla en Sobre el concepto de ironía y El concepto de la angustia. En ellas, Kierkegaard señala las determinaciones de este concepto y lo enmarca dentro de las posibilidades de la subjetividad en su relación con los otros y consigo misma. En la primera, la figura de Sócrates da cuenta de lo demoníaco en el sentido del (...) surgimiento y repliegue de la subjetividad que no participa de los asuntos públicos de la polis griega. En la segunda, Kierkegaard trata la situación demoníaca como un estado psicológico donde la conciencia da cuenta de su relación forzada con el bien y de su mantenimiento en la posición del mal, que lleva al individuo a un estado de endemoniamiento caracterizado por su incomunicación, vacuidad y aburrimiento. Este diagnóstico establece, pues, que los demonios kierkegaardianos son tanto la imposibilidad de la configuración social de los individuos, como su posibilidad a través de la formación de una fuerte subjetividad. In 1990 Edward Craig published a book called Knowledge and the State of Nature in which he introduced and defended a genealogical approach to epistemology. In recent years Craig’s book has attracted a lot of attention, and his distinctive approach has been put to a wide range of uses including anti-realist metaepistemology, contextualism, relativism, anti-luck virtue epistemology, epistemic injustice, value of knowledge, pragmatism and virtue epistemology. While the number of objections to Craig’s approach has accumulated, there has been no sustained (...) attempt to develop answers to these objections. In this paper we provide answers to seven important objections in the literature. (shrink)

Theories of epistemic justification are commonly assessed by exploring their predictions about particular hypothetical cases – predictions as to whether justification is present or absent in this or that case. With a few exceptions, it is much less common for theories of epistemic justification to be assessed by exploring their predictions about logical principles. The exceptions are a handful of ‘closure’ principles, which have received a lot of attention, and which certain theories of justification are well known to invalidate. But (...) these closure principles are only a small sample of the logical principles that we might consider. In this paper, I will outline four further logical principles that plausibly hold for justification and two which plausibly do not. While my primary aim is just to put these principles forward, I will use them to evaluate some different approaches to justification and (tentatively) conclude that a ‘normic’ theory of justification best captures its logic. Los instrumentos y los materiales están ahí para la construcción de un entorno tal, social y natural, en el que las pulsiones de vida no sublimadas redireccionarían el desarrollo de las necesidades y las facultades humanas, redirigirían el (...) progreso técnico. Estas condiciones previas están ahí para la creación de lo bello no como adornos, no como superficie de lo feo, no como pieza de museo, sino como expresión y objetivo de un nuevo tipo de hombre: como necesidad biológica en un nuevo sistema de vida. Este ensayo examina la idea de tolerancia en nuestra sociedad industrial avanzada. La conclusión a la que se llegó es que la realización del objetivo de la tolerancia requeriría intolerancia hacia las políticas, actitudes y opiniones prevalecientes y la extensión de la tolerancia a políticas, actitudes y opiniones que están prohibidas o reprimidas. A de minimis risk is defined as a risk that is so small that it may be legitimately ignored when making a decision. While ignoring small risks is common in our day-to-day decision making, attempts to introduce the notion of a de minimis risk into the framework of decision theory have run up against a series of well-known difficulties. In this paper, I will develop an enriched decision theoretic framework that is capable of overcoming two major obstacles to the modelling (...) of de minimis risk. The key move is to introduce, into decision theory, a non-probabilistic conception of risk known as normic risk. (shrink)

According to the principle of Conjunction Closure, if one has justification for believing each of a set of propositions, one has justification for believing their conjunction. The lottery and preface paradoxes can both be seen as posing challenges for Closure, but leave open familiar strategies for preserving the principle. While this is all relatively well-trodden ground, a new Closure-challenging paradox has recently emerged, in two somewhat different forms, due to Backes :3773–3787, 2019a) and Praolini :715–726, 2019). This paradox synthesises elements (...) of the lottery and the preface and is designed to close off the familiar Closure-preserving strategies. By appealing to a normic theory of justification, I will defend Closure in the face of this new paradox. Along the way I will draw more general conclusions about justification, normalcy and defeat, which bear upon what Backes :2877–2895, 2019b) has dubbed the ‘easy defeat’ problem for the normic theory. This paper seeks to widen the dialogue between the “epistemology of peer disagreement” and the epistemology informed by Wittgenstein’s last notebooks, later edited as On Certainty. The paper defends the following theses: not all certainties are groundless; many of them are beliefs; and they do not have a common essence. An epistemic peer need not share all of my certainties. Which response to a disagreement over a certainty is called for, depends on the type of certainty in question. Sometimes a (...) form of relativism is the right response. Reasonable, mutually recognized peer disagreement over a certainty is possible.—The paper thus addresses both interpretative and systematic issues. It uses Wittgenstein as a resource for thinking about peer disagreement over certainties. (shrink)

Recent developments in Continental philosophy have included the emergence of a school of “speculative realism,” which rejects the human-centered orientation that has long dominated Continental thought. Proponents of speculative realism differ on several issues, but many agree on the need for an object-oriented ontology. Some speculative realists identify realism with materialism, while others accord equal reality to objects that are non-material, even fictional. Several thinkers retain a focus on difference, a well-established theme in Continental thought. This paper looks at speculative (...) realism from the perspective of systems theory. Many of the tenets of speculative realism have long been features of systems metaphysics and are expressed clearly in a systems framework. However, some views of some speculative realists differ substantially from systems theoretic ideas. (shrink)

Our understanding of subjunctive conditionals has been greatly enhanced through the use of possible world semantics and, more precisely, by the idea that they involve variably strict quantification over possible worlds. I propose to extend this treatment to ceteris paribus conditionals – that is, conditionals that incorporate a ceteris paribus or ‘other things being equal’ clause. Although such conditionals are commonly invoked in scientific theorising, they traditionally arouse suspicion and apprehensiveness amongst philosophers. By treating ceteris paribus conditionals as a species (...) of variably strict conditional I hope to shed new light upon their content and their logic. (shrink)

In this paper I draw attention to a peculiar epistemic feature exhibited by certain deductively valid inferences. Certain deductively valid inferences are unable to enhance the reliability of one's belief that the conclusion is true—in a sense that will be fully explained. As I shall show, this feature is demonstrably present in certain philosophically significant inferences—such as GE Moore's notorious 'proof' of the existence of the external world. I suggest that this peculiar epistemic feature might be correlated with the much (...) discussed phenomenon that Crispin Wright and Martin Davies have called 'transmission failure'—the apparent failure, on the part of some deductively valid inferences to transmit one's justification for believing the premises. Metaphysical rationalism, the doctrine which affirms the Principle of Sufficient Reason (the PSR), is out of favor today. The best argument against it is that it appears to lead to necessitarianism, the claim that all truths are necessarily true. Whatever the intuitive appeal of the PSR, the intuitive appeal of the claim that things could have been otherwise is greater. This problem did not go unnoticed by the great metaphysical rationalists Spinoza and Leibniz. Spinoza’s response was to embrace necessitarianism. Leibniz’s (...) response was to argue that, despite appearances, rationalism does not lead to necessitarianism. This paper examines the debate between these two rationalists and concludes that Leibniz has persuasive grounds for his opinion. This has significant implications both for the plausibility of the PSR and for our understanding of modality. (shrink)

Fragmentalism was first introduced by Kit Fine in his ‘Tense and Reality’. According to fragmentalism, reality is an inherently perspectival place that exhibits a fragmented structure. The current paper defends the fragmentalist interpretation of the special theory of relativity, which Fine briefly considers in his paper. The fragmentalist interpretation makes room for genuine facts regarding absolute simultaneity, duration and length. One might worry that positing such variant properties is a turn for the worse in terms of theoretical virtues because such (...) properties are not involved in physical explanations and hence theoretically redundant. It will be argued that this is not right: if variant properties are indeed instantiated, they will also be involved in straightforward physical explanations and hence not explanatorily redundant. Hofweber and Lange, in their ‘Fine’s Fragmentalist Interpretation of Special Relativity’, object that the fragmentalist interpretation is in tension with the right explanation of the Lorentz transformations. It will be argued that their objection targets an inessential aspect of the fragmentalist framework and fails to raise any serious problem for the fragmentalist interpretation of special relativity. There is a type of metaphysical picture that surfaces in a range of philosophical discussions, is of intrinsic interest, and yet remains ill-understood. According to this picture, the world contains a range of standpoints relative to which different facts obtain. Any true representation of the world cannot but adopt a particular standpoint. The aim of this paper is to propose a regimentation of a metaphysics that underwrites this picture. Key components are a factive notion of metaphysical relativity, a deflationary notion (...) of adopting standpoints, and two kinds of valid inference, one that allows one to abandon standpoints and one that does not. To better understand how theories formulated in terms of this framework are situated in dialectical space, I sketch a theory in the philosophy of time that admits both temporal and atemporal standpoints. This article focuses on two developments in nineteenth-century (philosophy of) social science: Moritz Lazarus’s and Heymann Steinthal’s Völkerpsychologie and Georg Simmel’s early sociology of knowledge. The article defends the following theses. First, Lazarus and Steinthal wavered between a “strong” and a “weak” program for Völkerpsychologie. Ingredients for the strong program included methodological neutrality and symmetry; causal explanation of beliefs based on causal laws; a focus on groups, interests, tradition, culture, or materiality; determinism; and a self-referential model of social institutions. Second, (...) elements of the weak program were the blurring of explanatory and normative interests, an emphasis on freedom of the will, and antirelativism and antimaterialism. Third, later research projects keeping the label “Völkerpsychologie” followed the weak program. Fourth, in the 1880s and 1890s, Simmel tried to build on some of the elements of the strong program. Finally, and fifth, part of the explanation for why Simmel did not succeed in his attempt had to do with the social-political situation of German academia around 1900. (shrink)

Is it right to convict a person of a crime on the basis of purely statistical evidence? Many who have considered this question agree that it is not, posing a direct challenge to legal probabilism – the claim that the criminal standard of proof should be understood in terms of a high probability threshold. Some defenders of legal probabilism have, however, held their ground: Schoeman (1987) argues that there are no clear epistemic or moral problems with convictions based on purely (...) statistical evidence, and speculates that our aversion to such convictions may be nothing more than an irrational bias. More recently, Hedden and Colyvan (2019, section VI) describe our reluctance to convict on the basis of purely statistical evidence as an ‘intuition’, but suggest that there may be no ‘in principle’ problem with such convictions (see also Papineau, forthcoming, section 6). In this paper, I argue that there is, in some cases, an in principle problem with a conviction based upon statistical evidence alone – namely, it commits us to a precedent which, if consistently followed through, could lead to the deliberate conviction of an innocent person. I conclude with some reflections on the idea that the criminal justice system should strive to maximise the accuracy of its verdicts – and the related idea that we should each strive to maximise the accuracy of our beliefs. The starting point of this paper is the thought that the phenomenal appearances that accompany mental states are somehow only there, or only real, from the standpoint of the subject of those mental states. The world differs across subjects in terms of which appearances obtain. Not only are subjects standpoints across which the world varies, subjects are standpoints that we can ‘adopt’ in our own theorizing about the world (or stand back from). The picture that is suggested by these claims (...) has an appeal but is at the same time obscure and stands in need of regimentation. This paper explores and motivates a metaphysical account of what it is for subjects to be standpoints, what it is to adopt standpoints in our representations and, most importantly, how these notions might help us better understand the subjective character of conscious mental states. Some well-known observations by Thomas Nagel serve as starting points and the paper concludes by revisiting Nagel’s argument for the inevitable incompleteness of objective accounts of mental states, which will be reframed in terms of the central commitments of the proposed framework.
